By accessing or using SenioRides ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and SenioRides, Inc..
SenioRides provides a technology platform that connects senior passengers ("Passengers") with independent transportation providers ("Drivers"). SenioRides is not a transportation company and does not provide transportation services. All transportation services are provided by independent Drivers who are not employees, agents, or contractors of SenioRides.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. Passengers may book rides on behalf of seniors in their care.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify SenioRides immediately of any unauthorized use of your account. SenioRides reserves the right to suspend or terminate accounts that violate these Terms.
Ride fares are calculated based on distance, time, and applicable surcharges. All payments are processed through our secure payment processor. By requesting a ride, you authorize SenioRides to charge the payment method on file. Fares are non-refundable except as provided in our Cancellation Policy.
Passengers may cancel a ride without charge if cancelled more than 5 minutes before the scheduled pickup. Cancellations within 5 minutes of pickup may incur a cancellation fee. Scheduled rides may be cancelled without charge up to 30 minutes before the scheduled time.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENIORIDES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. SENIORIDES' TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC RIDE GIVING RISE TO THE CLAIM.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SENIORIDES DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
You agree to indemnify, defend, and hold harmless SenioRides and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service or violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Florida.
SenioRides reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the effective date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
